1. Acceptance of Terms
By submitting an application to Midnight Build Collective ("MBC," "we," "us," or "our") or otherwise using our website, community platforms, or programs (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not submit an application or use the Services.
2. Eligibility
MBC is a global community of women and non-binary builders. You must be at least 18 years old, or the age of majority in your jurisdiction, to apply. By applying, you represent that the information you provide is accurate and complete.
3. Membership Application & Review
Submitting an application does not guarantee membership. MBC reviews applications at its sole discretion based on criteria including alignment with our mission, community guidelines, and available capacity. We reserve the right to accept, waitlist, or decline any application without obligation to provide a specific reason, except where required by law.
4. Membership Conduct
Members agree to: treat other members, staff, and guests with respect; not engage in harassment, discrimination, or abusive conduct; not misrepresent their identity, credentials, or affiliations; and comply with any community guidelines or code of conduct published separately by MBC. MBC may suspend or terminate membership, at its discretion, for violations of these Terms or the community guidelines.
5. Intellectual Property
Content shared by MBC (branding, curriculum, event materials, and platform content) is owned by MBC or its licensors and may not be reproduced or redistributed without permission, except as needed for personal, non-commercial participation in MBC programs. Content that members share within MBC spaces (posts, project submissions, etc.) remains owned by the member, but the member grants MBC a non-exclusive, royalty-free license to display and use that content for community and promotional purposes, unless the member opts out in writing.
6. No Guarantee of Outcomes
MBC provides community, programming, and resources on an "as is" basis. We do not guarantee specific career, funding, or business outcomes from participation.
7. Disclaimers & Limitation of Liability
The Services are provided without warranties of any kind, express or implied. To the maximum extent permitted by law, MBC and its founders, staff, and volunteers are not liable for indirect, incidental, or consequential damages arising from your participation in or use of the Services.
8. Termination
You may withdraw your application or membership at any time by contacting us at hello@midnightbuildcollective.com. MBC may terminate or suspend access to the Services at its discretion, including for conduct that violates these Terms.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active members via email or posted on our website with an updated "Last Updated" date.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
